Terms of Service

1. Acceptance of Terms

By accessing or using the Hakware platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

These Terms constitute a legally binding agreement between you (or your organisation) and Hakware. Your continued use of the Services following any modification to these Terms constitutes acceptance of the revised Terms.

2. Description of Services

Hakware provides a cloud-based security management platform offering vulnerability assessment, monitoring, compliance management, and related security services. The specific features and modules available to you depend on your subscription tier.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time. We will provide reasonable notice of material changes where possible.

3. Account Registration and Security

You must register for an account to access most features of the platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorised use of your account. Hakware will not be liable for any loss resulting from unauthorised use of your account credentials.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services in any way that violates applicable laws or regulations, or that infringes the rights of any third party.

The security testing capabilities within the platform (including Hakware Archangel) must only be used against systems, networks, and assets that you own or have explicit written authorisation to test. Unauthorised use of penetration testing features against third-party systems is strictly prohibited and may result in immediate account termination and legal action.

You must not attempt to gain unauthorised access to the platform, other accounts, or the underlying infrastructure. You must not use the platform to transmit malware, conduct denial-of-service attacks, or engage in any other malicious activity.

5. Data Ownership and Security

You retain ownership of all data you input into the platform and all security data processed on your behalf. We process your data solely to provide the contracted Services.

We implement industry-standard security controls to protect your data. Our full data protection commitments are set out in our Data Processing Agreement, which is incorporated into these Terms by reference.

6. Subscription, Payment, and Cancellation

Access to the platform is provided on a subscription basis. Subscription fees are charged in advance for the agreed billing period. All fees are non-refundable except where required by applicable law.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Data export is available upon request prior to account closure.

7. Limitation of Liability

Hakware provides the platform on an "as is" basis. While we strive to maintain the highest service standards, we do not warrant that the platform will be uninterrupted, error-free, or that security findings will be exhaustive.

To the maximum extent permitted by applicable law, Hakware shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of cause.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
